These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Gay Social Corporation (“Gay Social,” “we,” “us,” or “our”) governing your access to and use of our website, communications, donations, ticket purchases, and participation in any Gay Social events or activities.

By accessing our website, registering for events, making a donation, purchasing tickets, or otherwise engaging with Gay Social, you agree to these Terms.

 

If you do not agree, please do not use our services or attend our events.

1. About Gay Social

Gay Social Corporation is a New Jersey-based organization that provides LGBTQ+ community programming and social events.

2. Eligibility to Participate

  • All Gay Social events are 18+ at minimum, unless explicitly stated otherwise.

  • Certain events may have higher age requirements (such as 21+ or 23+) due to venue policies, alcohol service, or the nature of the event. These age restrictions will be clearly disclosed on the event listing and ticketing page.

  • You are responsible for reviewing the age requirements for each event before registering or attending.

  • We reserve the right to request valid government-issued photo identification at the door.

  • Individuals who do not meet the stated age requirement will be denied entry and will not be eligible for a refund.

  • By using our services, you represent that all information you provide is truthful and accurate.

  • We reserve the right to refuse participation to any individual, consistent with applicable law.

We intentionally create affirming spaces for LGBTQ+ individuals and allies. These standards apply to all engagement with Gay Social, including events, digital platforms, communications, and partner venues.

Expected Conduct

You agree to:

  • Treat all individuals with dignity, empathy, and respect

  • Respect consent, boundaries, identities, and lived experiences

  • Contribute to a welcoming, inclusive environment

  • Follow the direction of organizers, volunteers, staff, and venue personnel

Prohibited Conduct (Zero Tolerance)

We do not tolerate:

  • Harassment, intimidation, bullying, or stalking

  • Discrimination or hateful conduct of any kind

  • Racism, sexism, homophobia, transphobia, biphobia, ableism, or other prejudice

  • Sexual misconduct or violations of consent

  • Physical aggression or threats

  • Disruptive, unsafe, or unethical behavior

Enforcement

To protect the safety, integrity, and wellbeing of our community, Gay Social reserves the right, at its sole discretion, to:

  • Refuse admission to events

  • Remove individuals from events

  • Restrict or revoke access to online platforms

  • Suspend or permanently ban participation

These actions may be taken when we reasonably believe that an individual’s conduct violates these Terms or undermines the safety or inclusiveness of our spaces. Enforcement may occur with or without prior warning.

No refunds will be provided when enforcement is based on misconduct.

4. Event Participation & Assumption of Risk

 

By attending any Gay Social event, you understand and acknowledge that participation involves inherent risks, including personal injury, illness, property loss, and interactions with other participants.

You voluntarily assume all risks associated with attendance and agree that Gay Social is not responsible for:

  • Personal injury or death

  • Loss, theft, or damage to personal property

  • Actions or omissions of other attendees

  • Conditions at third-party venues

  • Events beyond our reasonable control

This limitation applies to the fullest extent permitted under New Jersey law and applicable U.S. law.

5. Tickets, Donations, Payments, and Refunds

 

Unless otherwise stated in writing:

  • Event tickets are non-refundable except where required by law

  • Events may be rescheduled, modified, or canceled at our discretion

  • If Gay Social cancels an event, ticket holders will be offered a refund or credit

  • Tickets may not be resold for commercial purposes without written consent

  • All donations are voluntary and non-refundable to the fullest extent permitted by law

  • Donation processing and payment services are handled by Wix Payments or other authorized providers

Third-Party Ticketing and Payments

Some events may be ticketed or processed through third-party platforms or venues (for example, Eventbrite, Dice, a venue’s ticketing system, or direct venue sales).

In those cases:

  • Payment is made directly to the third party, not to Gay Social

  • Refunds, exchanges, and payment disputes are governed by the third party’s policies

  • Gay Social is not responsible for the processing of those payments or the handling of refunds

  • We encourage attendees to review the applicable third party’s terms and policies before completing a purchase.

6. Photography, Video, and Media Release

 

By attending Gay Social events, you acknowledge that photography, audio recording, and video recording may occur.

You grant Gay Social a royalty-free, perpetual, irrevocable, worldwide license to use images, audio, or recordings that include your likeness for:

  • Marketing and promotion

  • Social media

  • Website content

  • Educational or community materials

If you prefer not to be photographed or recorded, you may notify event staff. We will make reasonable efforts to accommodate your request, though we cannot guarantee exclusion from all incidental background capture.

The collection and use of images and recordings that may constitute personal data are also governed by our Privacy Policy, which explains how we handle and protect personal information.

7. Online Use and Digital Conduct

 

When engaging with Gay Social online (including our website, email, and social media), you agree not to:

  • Post unlawful, defamatory, abusive, or harmful content

  • Harass or target others

  • Impersonate individuals or organizations

  • Attempt unauthorized system access

  • Misuse our brand or intellectual property

We reserve the right to remove content or restrict access at our discretion.

8. Intellectual Property

 

All content associated with Gay Social, including logos, branding, event names, graphics, images, and written materials, is owned by Gay Social Corporation or its licensors and protected under U.S. intellectual property law.

You may not copy, reproduce, distribute, or use our materials without prior written consent.

9. Privacy and Data Protection

 

Your use of our services is also governed by our Privacy and Cookie Policy, which explains:

  • What personal information we collect

  • How we use and share information

  • How cookies and tracking technologies are used

  • How we protect sensitive personal data

  • Your rights under applicable privacy laws (including the NJDPA)

By using our services, you acknowledge and agree to the practices described in that policy.

10. Disclaimer of Warranties

 

Our website, events, and services are provided on an “as is” and “as available” basis. We make no guarantees regarding availability, accuracy, or suitability for any particular purpose.

11. Limitation of Liability

 

To the fullest extent permitted by law, Gay Social shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your participation in events or use of our services.

Our total liability for any claim will not exceed the amount paid by you to attend the relevant event, if applicable.

Some legal limitations may not apply in certain jurisdictions; this clause applies to the maximum extent permitted by law.

12. Indemnification

 

You agree to indemnify and hold harmless Gay Social Corporation, its directors, officers, volunteers, contractors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your conduct at events

  • Your misuse of our website or platforms

This is a standard provision used by U.S. nonprofits and event organizations.

13. Changes to These Terms

 

We may update these Terms periodically. Updates will be posted on our website with a revised effective date. Continued use of our services constitutes acceptance of the updated Terms.

14. Governing Law

 

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Any legal action related to these Terms must be brought in the state or federal courts located in New Jersey.
